Does the 0.4 mg THC Cap Apply to Full-Spectrum CBD Oil?

Section 781 caps total THC at 0.4 mg per container, not per serving. cbdMD's label says 2 mg THC per serving, so the bottle arithmetic answers it.

Yes. Section 781 of Public Law 119-37 sets a 0.4 mg combined total THC limit per container, not per serving, and it reaches any final hemp-derived cannabinoid product, full-spectrum CBD oil tinctures included. A tincture whose whole bottle carries more than 0.4 mg of total THC falls outside the federal hemp definition once the section applies to it.

That answers whether the 0.4 mg THC per container cap applies to full-spectrum CBD oil tinctures; the rest is the arithmetic, with one brand’s own numbers.

Does the 0.4 mg THC per container cap apply to full-spectrum CBD oil tinctures?

As RESTART CBD’s explainer (last updated August 25, 2026, read by this desk on September 14, 2026) summarises the text, the law excludes any final hemp-derived cannabinoid product containing more than 0.4 milligrams combined total tetrahydrocannabinols per container, THCA included, plus any cannabinoids the Department of Health and Human Services decides act like THC. A container is the innermost package or vessel in direct contact with the retail product: jar, bottle, bag, packet, can, carton, cartridge. For an oil, that is the bottle.

How much THC is in a full-spectrum CBD tincture, from one label

cbdMD’s full-spectrum CBD oil tincture page, read on September 14, 2026, prints “50, 100, or 200mg CBD + 2mg THC per serving” and “Up to 6000 mg CBD+THC Full Spectrum Formula per bottle”. In the page text we could read, it prints no serving count or bottle volume, and it does not mention the 0.4 mg cap. So the arithmetic below is ours.

The bottle figure is rougher, because the 6,000 mg line is a “CBD+THC” ceiling, but the order of magnitude holds. We tested nothing.

What about Charlotte’s Web, Lazarus Naturals and NuLeaf?

We tried three other names this site reviews. Charlotte’s Web’s CBD oil page and Lazarus Naturals’ full-spectrum tincture page returned Cloudflare block pages to this desk on September 14, 2026. NuLeaf Naturals’ lab-reports page opened, but the only THC line we could read was the footer’s “less than 0.3% delta-9 THC on a dry weight basis”, not a milligram figure.

We will not estimate those rows; this site does not print potency it did not read.

Is a 30 mL full-spectrum tincture over the cap? Read the COA

The label says delta-9 THC stays under 0.3% by weight; cbdMD’s page says exactly that under a “Farm Bill compliant” heading. True, and beside the point: the new test is total THC in milligrams per bottle, THCA included, and a COA reports it. Divide by 0.4 for your multiple. The reformulation shelf is broad-spectrum and isolate.

When does the new federal hemp THC limit take effect?

RESTART CBD’s August 25 update said the Senate had passed a delay to December 11, 2026 that still needed the House and the president. Both have now happened. The enrolled text of H.R. 6500, carries Section 2019, headed “Section 781 Extension”, which says that until December 11, 2026 the section 781 amendments “shall only apply with respect to products described in” specific paragraphs of the new definition. The White House records it as signed into law on September 2, 2026.

The November 12, 2026 date in the underlying law is not repealed; Section 2019 narrows what the amendments apply to until December 11. We did not resolve which products those paragraphs describe, so we will not say whether a full-spectrum tincture sits inside that narrowing. Under the federal hemp definition in existing law, a full-spectrum tincture with more than 0.4 mg total THC in the bottle stops being hemp once Section 781 applies to it. State law is a separate question, and we do not write “legal everywhere”.
