Does the 0.4 mg THC Cap Apply to Broad-Spectrum CBD?

Yes: the cap counts total THC per bottle, THC-free or not. We read the statute and a lab report to show when an ND result proves a bottle passes.

Yes. Section 781 of Public Law 119-37 counts total THC, THCA included, at 0.4 mg combined per container, and the lines this desk read make no exception for products sold as THC-free. So once in force, the 0.4 mg THC cap applies to broad-spectrum CBD and isolate alike.

Does the 0.4 mg THC cap apply to broad-spectrum CBD?

This desk read the enrolled text of Public Law 119-37 on October 3, 2026. Section 781 excludes from hemp a product with “greater than 0.4 milligrams combined total per container” of total THC.

What does ND mean on a CBD lab report?

ND means none detected: below what the lab’s method can measure, not zero. An ND bottle could hold up to the limit of quantification (LOQ) times its volume.

This desk read a Joy Organics certificate of analysis on October 3, 2026: a 2021 Botanacor report for a full-spectrum, not broad-spectrum, tincture, batch 21252A. Its cannabinoid LOQs run from 0.105 to 0.574 mg/mL; 1,436.2 mg of CBD at 47.872 mg/mL makes a 30 mL bottle.

At 0.105 mg/mL, an ND across 30 mL could still hide 3.15 mg of THC. Proving a 30 mL bottle under 0.4 mg needs an LOQ near 0.0133 mg/mL.

When does the hemp THC cap take effect?

Section 781 runs 365 days from enactment, November 12, 2026. Akerman reports H.R. 6500 moves non-synthetic products to December 11, 2026; the White House says the President signed it on September 2, 2026.

Frequently asked questions

Is broad spectrum CBD still legal? Federally, broad-spectrum CBD stays hemp only while it meets the hemp definition, which from the effective date means 0.4 mg or less of total THC per container. State law is a separate question, and a THC-free label is the brand’s own claim.

Does broad spectrum CBD have THC? It is marketed as THC-free, and its batch report may read ND for THC. ND is not zero: the result sat below that lab’s limit of quantification. Whether that proves a bottle is under 0.4 mg depends on the limit and the bottle size.

Will CBD isolate be banned? The Section 781 lines this desk read do not single out isolate. It faces the same test as any final hemp-derived cannabinoid product: 0.4 mg of total THC per container or less keeps it inside the federal definition, and more puts it outside.
